Article 1 — Purpose and acceptance
These terms govern the use of MyRunningAPP, a running app, and its associated services. Creating an account constitutes full and unreserved acceptance. If you do not accept these terms, do not use the app.
Article 2 — Publisher and host
PUBLISHER AND PUBLICATION DIRECTOR — Michaël Chabaud, sole trader trading as Yune Production, 1249 avenue Jean Moulin, 13480 Cabriès, France, SIREN 932 830 144. Contact: contact@mysportapp.fr. DATA HOST — Supabase, Inc., 970 Toa Payoh North #07-04, Singapore. Production infrastructure located in the European Union (Ireland). WEBSITE HOST — Infomaniak Network SA, Rue Eugène-Marziano 25, 1227 Genève, Switzerland, hosts the whole mysportapp.fr website, legal pages and beacon page included. DISTRIBUTION — Apple Inc. (One Apple Park Way, Cupertino, CA 95014, USA) and Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA).
Article 3 — Registration and account
Access requires an account, created with a valid email address or by signing in with Apple or Google. An account is personal: it may not be lent or resold. You are responsible for keeping your credentials confidential and for actions taken from your account. Report any unauthorised access to us without delay. The information you provide must be accurate. An account created under a false identity may be suspended.
Article 4 — Rules of use
The app is intended for personal, non-commercial use. The following are prohibited: harassment; hateful, discriminatory or violent speech; sexual content; impersonation; solicitation and spam; automated data extraction; any attempt to circumvent technical protections; recording falsified activities (for example done in a vehicle, or altered) to distort a challenge, a segment or a leaderboard. We apply zero tolerance to unlawful content. Any content can be reported from within the app, and any user blocked.
Article 5 — The content you post
You remain the owner of what you post: activities, photos, comments, messages. You grant us a free, non-exclusive licence to host it and display it to the people you have chosen, for the sole duration necessary to operate the service. You warrant that you hold the rights to what you post, in particular photographs featuring other people. RESPECT OTHER PEOPLE'S PRIVACY. Do not post a photo in which a person can be recognised without their agreement, mention only friends who accept it, and never reveal another person's home, travel habits or location. A beacon link entrusted to you may not be passed on without the agreement of the person who created it. We may remove without notice any content reported as manifestly unlawful, in accordance with our obligations as a host.
Article 6 — Groups, clubs and challenges
The “clubs” and groups in the app are created and run by users. They have no official, contractual or commercial link with real running clubs or associations: those take no part in the app, publish nothing in it and validate no content. Official challenges are offered by the app and constitute neither a competition nor a sanctioned event. They carry no prize. Group runs and meetings arranged in the app are the sole responsibility of the participants. Naming a club serves only to locate a community of runners — it implies no partnership, endorsement or liability on the club's part.
Article 7 — Running: your safety
You run at your own risk. Make sure your state of health allows you to take part, in particular before resuming or stepping up training; medical advice is recommended. Stay alert to your surroundings: obey the highway code and respect private property, adapt your pace and route to the terrain, the weather and the light, and do not look at your phone or watch when doing so puts you in danger. The maps rely on collaborative data (OpenStreetMap) and routes are calculated automatically: they may be inaccurate, or pass along roads or paths that are dangerous, closed or off-limits to pedestrians. Always check on the spot that the way is safe and permitted.
Article 8 — The beacon is not an emergency service
The beacon lets people of your choice follow your location during an activity. It depends on your phone's mobile network, GPS and battery: the location may be inaccurate, delayed or stop without warning. Nobody at MySportAPP monitors beacons, and the app triggers no alert. The beacon DOES NOT REPLACE THE EMERGENCY SERVICES: in an emergency, call 112 or the local emergency number. Anyone who has the link sees your location until it expires. Send it only to people you trust.
Article 9 — Predictions, plans and paces
Time predictions, training plans, target paces, heart-rate zones, calories, training load and other indicators are ESTIMATES calculated from your activities. They are indicative, guarantee no result and must be adjusted to how you feel. In the event of pain, feeling unwell or unusual breathlessness, stop and consult a healthcare professional. The app is not a medical device and provides no medical advice. Its indicators do not replace the opinion of a doctor or a qualified coach.
Article 10 — Subscriptions
The app is free. Two optional subscriptions unlock the Pro features: THE APP SUBSCRIPTION unlocks the Pro features in MyRunningAPP only. MYSPORTAPP UNLIMITED unlocks them across all the apps in the family. The prices shown in the app prevail; they include applicable taxes and may vary by country. Billing is handled by Apple or Google depending on your device. Payment is taken on purchase confirmation, then the subscription renews automatically for an equivalent period unless turned off at least 24 hours before the end of the current period, in your Apple or Google account settings. Where a free trial is offered, the paid subscription starts when it ends, unless cancelled before that date. You may cancel at any time: Pro access remains active until the end of the period already paid for. Refunds are handled exclusively by Apple or Google, under their own terms.
Article 11 — Right of withdrawal
As a consumer in the European Union, you are in principle entitled to a fourteen-day withdrawal period from the date of subscription. However, access to the Pro features is provided IMMEDIATELY after purchase. By subscribing, you expressly request that immediate performance and acknowledge that you lose your right of withdrawal once the service has been fully supplied, in accordance with Article L221-28 of the French Consumer Code. Independently of that right, Apple and Google apply their own refund policies, often more favourable. Any request must be addressed to them directly.
Article 12 — Intellectual property
The app, its code, design, trade marks, logos and editorial content are protected by copyright and trade mark law. Any reproduction, adaptation or exploitation without written permission is prohibited. The names of clubs, races, equipment brands and federations mentioned belong to their respective owners and are cited for information only. Map data © OpenStreetMap contributors, under the ODbL licence. Weather data is provided by Apple Weather (sources: https://weatherkit.apple.com/legal-attribution.html).
Article 13 — Availability and liability
The app is provided “as is”. We take reasonable steps to keep it working properly, without guaranteeing uninterrupted availability or the complete absence of error. The accuracy of GPS, maps, weather, the Health import and the watch depends on your device and on third-party services. We are not liable for indirect damage, nor for the consequences of a service interruption, a loss of data due to a cause outside our control, or the use you make of the sporting information computed by the app. Accidents, injuries or damage occurring during an activity are your responsibility and that of the people involved. None of these limitations applies in the event of gross negligence or wilful misconduct, nor to the rights that the law mandatorily grants to consumers.
Article 14 — Suspension and termination
You may delete your account at any time from Profile → Data and privacy. We may suspend or delete an account in the event of a serious breach of these terms, after prior notice save in cases of urgency or legal obligation. A subscription running at the time of a suspension for breach does not entitle you to a refund from us.
Article 15 — MySportAPP: the family of apps
These terms apply to MyRunningAPP. The other apps in the MySportAPP family, to which your single account gives access, have their own terms. Each app remains separate: its own store listing, its own subscription, its own sporting data. What is shared and what is not is set out in Article 14 of the privacy policy.
Article 16 — Personal data
The processing of your personal data is described in the privacy policy, which forms an integral part of these terms. It sets out in particular the data collected, the use of your location and health data, the purposes, the legal bases, the providers, the retention periods and the means of exercising your rights.
Article 17 — Changes to these terms
These terms may be amended. Any substantial change will be signalled in the app at your next sign-in. If you refuse the new terms, you may delete your account. Continued use after notification constitutes acceptance.
Article 18 — Governing law and disputes
These terms are governed by French law, without depriving a consumer of the protection of the mandatory provisions of the law of their country of residence. In the event of a dispute, we invite you to contact us first so that an amicable solution can be sought. You may also use a consumer mediator free of charge. Failing agreement, the competent courts are those designated by the applicable legal rules.
